Lessons Learned from Past Mistakes and Misadventures over Many Years and Through Many Types of Public Interest Practice
Originally presented as a break-out session of the 2020 Public Interest Law Day
A panel of senior public interest practitioners will discuss mistakes they have made, how they have tried to fix the mistakes, what they have learned in the process, the ethical challenges encountered, and the ethical rules implicated. This video-encore panel will cover problems arising in different contexts, including litigation, transactional work, and working with the media. For example, what to do when an email containing an attorney’s candid observations on how to persuade a government agency is mistakenly forwarded to community members, or how to handle a client’s creation of a false document to help their case. These ethical issues and more will be analyzed. Panelists will also include an examination of the necessity of the newly adopted Disciplinary Rule 8.4(g) prohibiting knowingly manifesting bias or prejudice in the practice of law.
