Ethical Issues Related to Remote Working, Data Security, and New Technology
Originally presented as a break-out session of the 2020 Public Interest Law Day
The COVID-19 pandemic has caused attorneys to quickly transition from performing legal work in their offices to working remotely from home, sometimes in less than ideal circumstances. Remote work presents attorneys with complex ethical challenges. Often, attorneys are required to access, edit, and store their documents remotely or in the cloud. Cloud storage raises questions about data confidentiality. Further, attorneys face the dilemma of meeting their ethical obligations to communicate effectively with clients while conforming to pandemic shutdown requirements. Attorneys are often meeting with clients or conducting court hearings remotely. But many low income clients lack access to technology, services, and space, which makes remote communication difficult.
This video-encore CLE program will focus on the ethics of cloud computing and remote client communication through the lens of COVID-19. The panelists will address ethics-related constraints of remote legal work and will also discuss best practices particularly as related to maintaining client confidentiality while working remotely.
