Hosted by the Federal Courts Committee in collaboration with the U.S. District Court for the Eastern District of Pennsylvania 

This half-day annual conference offers in-depth CLE discussions on legal and practice topics important to the Federal Court Practice community in the Eastern District of Pennsylvania. The Federal Bench Bar Conference provides a forum for the interchange of ideas among the bench and bar, educates the bar with regard to practice in the courts and encourages civility in the courts.  This year's conference is a virtual endeavor that will address the following scheduled topics:

12:45p -  1:45p - Current State of Court Operations, Practice and Procedure
This panel will examine how the Courts are continuing to operate due to the restrictions in place related to COVID-19.  The discussion will include practical tips and considerations for effectively interacting with the Court, the Clerk’s offices, and its Judges during these unprecedented times.  Via the chat feature, attendees may ask questions and share their own experiences about how Court interactions are currently being handled.

2:00p - 3:00p - Best Practices for Effective Federal Criminal Sentencing Advocacy
This session will explore a variety of topics related to Federal sentencing practice and procedure, exploring the perspectives of the Court, the government and the defense. We will discuss the strategies employed by the parties in litigating sentencing issues, presenting arguments in aggravation and mitigation as well as the perspective of the sentencing judge on these strategies and tactics. The session will explore topics such as the Pre-Sentence Investigation process and its relationship to guideline stipulations in plea agreements; sentencing considerations post-trial versus pursuant to a guilty plea; the most effective strategies for presenting victim impact evidence and character evidence on behalf of a defendant; the interplay between restitution and forfeiture issues at sentencing; as well as sentencing considerations in the era of COVID-19.

3:15p - 4:15p - Planning for a Successful Mediation
This session will focus on discussing tips and strategies related to how participants can get the most out of a mediation with a Federal Magistrate Judge.  We will consider what type of preparation participants should do before the mediation to maximize the chances for a successful result, how to prepare persuasive mediation statements, obtaining appropriate settlement authority, and who should attend from the client.  We will also consider what arguments are most likely to resonate on the day of the mediation; and negotiating strategies that are likely to be the most fruitful.  We will also discuss handling mediations that are done on the telephone, or on the computer, because of COVID-19 restrictions.
