Religious Freedom (to Discriminate?): The Intersection of Religious Freedom and LGBTQ Non-Discrimination Protections

Hosted by the LGBT Rights

The United States Supreme Court’s decision in Bostock v. Clayton County held that Title VII of the Civil Rights Act protects against discrimination based on sexual orientation and gender identity, seemingly embracing an interpretation of federal anti-discrimination law which has been long fought for by advocates for equality. However, Justice Gorsuch’s opinion references the possibility that religious freedom concerns may create the need for exceptions to anti-discrimination protections. The increasingly rightward shift of the Supreme Court following the confirmation of Justice Barrett prompts concerns about a hypothetical case which might argue that closely-held religious belief may override those protections. One such case out of Philadelphia, concerning the City’s termination of its contractual relationship with Catholic Social Services on the basis of the organization’s refusal to abide by anti-discrimination protections, Fulton v. City of Philadelphia, may be a sign of what is to come. Is religious freedom an exception that will swallow the rule, enshrining a “freedom to discriminate”?
