Applying Fair Housing Law to Rental Evictions in Philadelphia


Hosted by the Municipal Court Committee

Approximately 20,000 households each year in Philadelphia are subject to an eviction filing from the public and private housing stock. Typically, in those filings, landlords are seeking money for unpaid rent, possession of their housing unit, or both. While many of those cases are straightforward in terms of the substance of the controversy, some involve fair housing issues. The federal Fair Housing Act (Act), passed in 1968 and modified by Congress several times since, makes it unlawful to discriminate in the rental, sale or financing of housing on the basis of race, color, religion, sex, national origin, handicap or familial status. Pennsylvania’s substantially equivalent PA Human Relations Act sets forth additional bases. The Act has a built-in enforcement mechanism and penalties for violation of its provisions. In addition to the Act, there are other laws that may be applicable based on the nature of the housing, such as Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act. Notwithstanding all of these laws, research shows that much discrimination in housing goes undetected or unreported (or both). 

This CLE program is designed to provide attorneys, judges, court staff and administrators, and others who are involved in the eviction process a fundamental grounding in the rights and obligations of landlords and tenants under the nation’s fair housing laws. Guidance on the laws and regulations will be followed by actual case examples of discrimination in rental housing as a vehicle to sensitize session participants to what potential fair housing violations look like.
