As the use of social media has become ubiquitous in today’s society, so has the necessity to obtain evidence in litigation from the social networking. Firms and cases of every size can be affected by social media – both in the duty to preserve social media content and in the desire to access relevant social media evidence in litigation.  Attempting to view and collect such evidence, however, presents unique ethical issues.

As is the case with discovery generally, the handling of social media content requires lawyers to consider and balance their obligations to clients, adversaries and the court.  In this video-encore CLE program, our panelists offer guidance regarding social media discovery and any limitations, preservation and spoliation issues with the social media evidence, and the ethical pitfalls that social media can present.
