Demonstrative Evidence, Psychology of Persuasion and the Psychology of Settlement

Presented  with LawPay

FREE to  Philadelphia Bar Association members in good standing!

Throughout your case attorneys will be telling their client’s story. Studies have shown that visual presentations can communicate more information faster and the recipient will retain more data with greater accuracy for a longer period of time.  Demonstrative exhibits and aids provide the means “to clarify, to dramatize and to emphasize” critical substantive evidence in a case and makes the issues easier to understand and to follow.

Persuasion is a deliberate effort to change a person's attitude. The ability to persuade is dependent upon several things, including credibility and likeability, understanding the audience, and how the message is framed. Persuading juries or another party in arbitration/mediation can be a nuanced and complicated process.  Understanding the psychology and principles of persuasion will increase your ability to persuade and to sway attitude and judgement in your client's favor.

This video-encore program’s first hour entitled, Preparing and Presenting Demonstrative Evidence and the Psychology of Persuasion, explores the differences between demonstrative evidence and demonstrative aids, as well as how they are used, the requirements of each, the dangers of certain types, and the use of a “trial script.” This hour will also highlight three learning styles and learning domains that you should know

The second hour entitled, The Psychology of Settlement, ethically examines why some lawyers excel at the settlement process, and others fail.  It’s a matter of identifying client goals and alternatives early on, honesty as an advocate and opponent, having the respect of the court, and cultivating productive relationships with opposing counsel.  Learn the biology of decision-making and the “seven steps” to good decisions.
