In this video-encore program, Transnational Litigation in U.S. Federal Courts, Sean Carter, the featured speaker, examines the unique challenges that arise when transnational disputes are litigated in United States Federal courts. A feature of the modern global economy is an ever-increasing amount of transnational litigation. Transnational disputes may involve litigants that are domiciled or located abroad; conduct that occurred abroad; or parallel judicial proceedings that are filed in the courts of other nations.

Mr. Carter has been lead counsel for dozens of insurers in the multi-district litigation, In re Terrorist Attacks of September 11, 2001, pending in the United States District Court for the Southern District of New York, in which the court upheld jurisdiction over the Kingdom of Saudi Arabia under the (JASTA). In  this program, he addresses the legal framework for pursuing claims against foreign state defendants in U.S. courts under the Foreign Sovereign Immunities Act (FSIA), particular challenges in the 9/11 litigation that prompted the enactment of the Justice Against Sponsors of Terrorism Act (JASTA), and more.
